These terms govern the use of the ArchivPro platform for the digital archiving of business information. By registering and using the service, you agree to the following provisions.
ArchivPro provides a secure platform for the structured capture, versioning, and archiving of business-critical documents. The service includes role-based access control, traceable change logs, and features to support compliance processes. The exact scope of functions is determined by the service variant you have booked and the documentation on the platform.
You are responsible for the proper maintenance of your access credentials and for ensuring that unauthorized third parties do not gain access to your account. You undertake not to upload any documents that violate applicable law or infringe the rights of third parties. Compliance with data protection regulations, in particular the GDPR, is your responsibility as the controller for the content you upload.
The operator provides the platform with reasonable care and strives for high availability. However, guaranteed availability only exists within the scope of technically possible operating times. Maintenance work that affects accessibility will be announced in advance where possible. The operator processes personal data exclusively in accordance with the privacy policy and legal requirements.
The operator is fully liable for intent and gross negligence, as well as for damages resulting from injury to life, body, or health. For simple negligence, the operator is only liable in the event of breach of essential contractual obligations, limited to the contract-typical, foreseeable damage. Liability for indirect damages, lost profits, and data loss is excluded, unless these are based on intentional or grossly negligent conduct. You are obliged to regularly create your own backup copies of your data.
Unless otherwise agreed, the contract for the use of ArchivPro is concluded for an indefinite period and can be terminated by either party with four weeks' notice to the end of the month. After termination of the contractual relationship, your data will be deleted after the statutory retention periods have expired, unless there is a legal obligation to continue storing it. You can export your data in a common format until termination.
The operator reserves the right to adjust these terms if this is necessary to comply with legal or regulatory requirements or to reflect significant functional changes to the platform. You will be informed of significant changes by email to the address provided during registration. If you do not object to the change within six weeks of receipt of the notification, the amended terms will be deemed accepted. Your right to object will be specifically indicated in the notification.
Austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from this contractual relationship is, to the extent legally permitted, the registered office of the operator. Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
